(주)퍼즐스페이스(이하 ‘회사’)는 이용자의 소중한 개인정보를 보호하기 위해 개인정보보호 관련 법령을 준수합니다.

회사는 본 개인정보처리방침을 통해 이용자가 제공하는 개인정보를 어떠한 목적과 방식으로 이용하고 있는지, 이용자의 개인정보를 보호하기 위해 회사가 어떠한 노력을 기울이고 있는지 알려드리고자 합니다.

회사의 개인정보처리방침은 정부의 법률 및 지침 변경이나 회사의 내부 방침 변경 등으로 인하여 수시로 변경될 수 있으며, 회사가 개인정보처리방침을 개정하는 경우 그 변경사항을 이용자가 쉽게 알아볼 수 있도록 고지하고 있습니다. 또한 개인정보처리방침을 공개함으로써 이용자가 언제나 용이하게 확인할 수 있도록 하고 있습니다.

제 1 조 [개인정보의 처리목적]

회사는 서비스의 제공과 고객 상담 등을 위해 개인정보를 수집하고 있습니다.

① 게임서비스 이용

게임서비스 제공, 서비스 제공에 따른 본인인증, 구매 및 요금결제, 상품 및 서비스의 배송 등

② 고객 상담

서비스 이용에 따른 본인확인, 개인의 식별, 만 14세 미만 아동의 개인정보 수집 시 법정 대리인의 동의여부확인, 추후 법정 대리인 본인확인, 분쟁 조정을 위한 기록보존, 불만처리 등 민원처리, 고지사항 전달 등

③ 신규 서비스 개발, 광고 및 마케팅에 활용

신규 서비스 개발 및 맞춤 서비스 제공, 통계학적 특성에 따른 서비스 제공 및 광고 게재, 서비스의 유효성 확인, 이벤트 및 광고성 정보 제공 및 참여기회 제공, 접속빈도 파악, 이용자의 서비스 이용에 대한 통계 등

제 2 조 [수집하는 개인정보 항목 및 수집방법]

회사는 다음의 개인정보 항목을 처리하고 있습니다.

① 게임서비스 이용

・필수항목 : ID(이메일), 게임이용 및 접속기록, 인증기록, 결제기록, 게임버전, 단말기 정보(모델명, OS 종류 및 버전, 기기식별자등)

※ 단말기 OS 버전에 따라 수집 항목이 일부 다를 수 있습니다.

・수집 방법 :  게임 접속 시 로그인

제 3 조 [개인정보의 처리 및 보유기간]

회사는 이용자의 개인정보를 고지 및 동의 받은 기간 동안 보유하고 이용하며, 개인정보의 수집 및 이용목적이 달성되거나 보유기간 만료, 이용자의 수집 및 이용 동의 철회 시 지체 없이 파기하는 것을 원칙으로 합니다.

최종 로그인 후 1년 동안 이용 기록이 없는 장기 미이용자는 관련법령에 따라 개인정보 보호를 위해 계약을 해지하고 개인정보 파기 등 필요한 조치를 취할 수 있습니다.

이 경우, 조치일 30일 전까지 필요한 조치가 취해진다는 사실과 개인정보 보유기간 만료일 및 개인정보의 항목을 "회원"에게 통지합니다.

  보존이유: 정보통신망 이용촉진 및 정보보호 등에 관한 법률

  보존기간: 6개월

・서비스 방문기록

  보존이유: 통신비밀보호법

  보존기간: 3개월

제 4 조 [개인정보의 파기]

이용자의 개인정보는 수집 및 이용목적이 달성되면 지체 없이 파기되며, 파기 절차 및 방법은 다음과 같습니다.

・파기절차 : 해당 유저가 개발자 이메일로 삭제를 요청시 즉시 개인정보를 파기합니다.

・파기방법 : 전자적 파일 형태로 저장된 개인정보는 기록을 재생할 수 없는 기술적 방법을 사용하여 삭제합니다.

제 5 조 [개인정보의 제3자 제공] 

회사는 이용자의 개인정보를 제1조(개인정보의 처리 목적)에서 명시한 범위 내에서만 처리하며 다만, 아래의 경우에는 주의를 기울여 개인정보를 이용 및 제공 할 수 있습니다.

・법령의 규정에 의거하여 자료 제공이 강제되는 경우 또는 적법한 절차에 의한 법원, 수사기관, 기타 행정기관의 요청이 있는 경우

・서비스 제공에 따른 요금 정산을 위해 필요한 경우

・게시한 서비스 이용약관이나 기타 회원 서비스 등 이용약관 또는 정책을 위반한 경우

제 6 조 [개인정보처리의 위탁]

회사는 이용자의 동의 없이 개인정보를 외부 업체에 위탁하지 않습니다.

다만, 필요가 생길 경우 위탁 대상자와 업무 내용에 대해 이용자에게 통지하고 사전 동의를 받습니다.

제 7 조 [이용자 및 법적대리인의 권리와 그 행사방법]

・회원 및 법정 대리인은 언제든지 등록되어 있는 본인 혹은 당해 만 14세 미만 아동의 개인정보를 조회하거나 수정할 수 있으며 가입 해지를 요청할 수도 있습니다.

・회원 혹은 만 14세 미만 아동의 개인정보 조회·수정을 위해서는 ‘개인정보변경’(또는 ‘회원정보수정’ 등)을, 가입 해지(동의철회)를 위해서는 “회원탈퇴”를 클릭 하여 본인 확인 절차를 거치신 후 직접 열람, 정정 또는 탈퇴가 가능합니다.

・회원은 본인의 개인정보에 대한 정정 또는 삭제를 요구하는 경우 회사는 본인 여부를 확인한 후 지체 없이 필요한 조치를 취합니다.

・회사는 고객 혹은 법정 대리인의 요청에 의해 해지 또는 삭제된 개인정보는 “제3조 (개인정보의 보유 및 이용기간)” 에 명시된 바에 따라 처리하고 그 외의 용도로 열람 또는 이용할 수 없도록 처리하고 있습니다.

제 8 조 [개인정보 자동 수집 장치의 설치・운영 및 거부에 관한 사항]

회사는 쿠키 등 인터넷 서비스 이용 시 개인정보를 자동 수집되는 장치를 운영하지 않습니다.

제 9 조 [개인정보의 안전성 확보조치] 

회사는 이용자의 개인정보를 처리함에 있어 개인정보가 분실, 도난, 유출, 변조 또는 훼손되지 않도록 안전성 확보를 위하여 다음과 같은 기술적/관리적 대책을 강구하고 있습니다.

① 비밀번호 암호화

이용자 아이디(ID)의 비밀번호는 암호화되어 저장 및 관리되고 있어 이용자만 알고 있으며, 개인정보의 확인 및 변경도 비밀번호를 알고 있는 이용자에 의해서만 가능합니다.

회사는 이용자들의 개인정보를 보호하고 개인정보와 관련된 불만 및 고충을 처리하기 위하여 아래와 같이 개인정보 보호책임자 및 담당부서를 지정하고 있습니다.

회사는 홈페이지에 다른 회사의 웹 사이트 또는 자료에 대한 링크를 제공할 수 있습니다. 홈페이지에 링크되어 있는 다른 회사의 웹 사이트로 이동할 경우, 해당 웹 사이트의 개인정보처리방침이 적용됩니다.

제 12 조 [고지의 의무]

개인정보처리방침의 내용 추가, 삭제 및 수정이 있을 시에는 개정 7일전부터 ‘공지사항’을 통해 공지하는 것을 원칙으로 하며, 고객에게 불리하게 변경되는 내용은 개정 30일 이전부터 고지합니다.

제 1 조 [목적]

이 약관은 (주)퍼즐스페이스(이하 “회사”라고 함)가 디바이스를 통해 제공하는 모든 게임 및 제반 서비스의 이용과 관련하여 회사와 이용자의 권리와 의무, 책임 사항 및 기타 필요한 제반 사항을 정하는데 그 목적이 있습니다.

제 2 조 [용어의 정의]

① 이 약관에서 사용하는 용어의 정의는 다음과 같습니다.

  1.'이용자'란 회사가 제공하는 모든 게임 및 제반 서비스를 이용하는 자(회원, 비회원 포함)를 말합니다.

  2.'임시이용자'란 계정정보를 외부계정과 연동 또는 인증을 하지 않거나 게스트 로그인 모드를 통해 서비스를 이용하는 회원을 의미합니다.

  3.`콘텐츠’란 회사가 디바이스를 통해 제공하는 모든 게임 및 네트워크 서비스, 어플리케이션, 게임 머니 및 게임 아이템 등 서비스와 관련되어 디지털 방식으로 제작한 유료 또는 무료의 내용물 일체를 말합니다.

  4.'디바이스’란 콘텐츠를 다운로드 받거나 설치하여 사용할 수 있는 휴대폰, 스마트폰, 휴대폰정보단말기(PDA), 태블릿 등의 기기를 말합니다.

  5.'네트워크 서비스’란 인터넷에 연결하여 네트워크 게임 이용, 게임머니 또는 아이템 등의 구매, 랭킹등록, 게시물 작성 등을 할 수 있도록 회사가 제공하는 서비스 일체를 말합니다.

② 이 약관에서 사용하는 용어의 정의는 1항에서 정하는 것을 제외하고는 서비스별 운영정책에서 정하는 바에 의하며, 서비스별 운영정책에서 정하지 않는 것은 관계법령 및 일반적인 상관례에 의합니다.

제 3 조 [회사 정보 등의 제공]

회사는 관계 법령에 따라 다음 각호의 사항을 회원이 알아보기 쉽도록 표시합니다.

1. 상호 및 대표자의 성명, 영업소 소재지 주소 및 전화번호, 전자우편주소

2. 이용 약관 및 개인정보처리방침

제4조 [약관의 효력 및 변경]

① 회사는 이 약관의 내용을 회원이 알 수 있도록 게임서비스 내 또는 그 연결 화면에 게시합니다. 이 경우 이 약관의 내용 중 서비스 중단, 청약철회, 환급, 계약 해제ㆍ해지, 회사의 면책사항 등과 같은 중요한 내용은 굵은 글씨, 색채, 부호 등으로 명확하게 표시하거나 별도의 연결 화면 등을 통하여 회원이 알아보기 쉽게 처리합니다.

② 회사가 약관을 개정할 경우에는 적용일자 및 개정내용, 개정사유 등을 명시하여 최소한 그 적용일 7일 이전부터 게임서비스 내 또는 그 연결 화면에 게시하여 회원에게 공지합니다. 다만, 변경된 내용이 회원에게 불리하거나 중대한 사항의 변경인 경우에는 그 적용일 30일 이전까지 본문과 같은 방법으로 공지합니다. 이 경우 개정 전 내용과 개정 후 내용을 명확하게 비교하여 회원이 알기 쉽도록 표시합니다.

③ 회사가 약관을 개정할 경우 개정약관 공지 후 개정약관의 적용에 대한 회원의 동의 여부를 확인합니다. 회원이 개정약관에 대해 동의 또는 거부의 의사표시를 하지 않으면 동의한 것으로 볼 수 있다는 내용도 함께 공지 또는 통지를 하며, 회원이 이 약관 시행일까지 거부의 의사표시를 하지 않는다면 개정약관에 동의한 것으로 볼 수 있습니다. 회원이 개정약관에 대해 동의하지 않는 경우 회사 또는 회원은 서비스 이용계약을 해지할 수 있습니다.

④ 회사는 회원이 회사와 이 약관의 내용에 관하여 질의 및 응답을 할 수 있도록 조치를 취합니다.

⑤ 회사는 「전자상거래 등에서의 소비자보호에 관한 법률」, 「약관의 규제에 관한 법률」, 「게임산업진흥에 관한 법률」, 「정보통신망이용촉진 및 정보보호 등에 관한 법률」, 「콘텐츠산업진흥법」 등 관련 법령에 위배하지 않는 범위에서 이 약관을 개정할 수 있습니다.

제5조 [이용계약의 체결 및 적용]

① 이용계약은 회원이 되고자 하는 자(이하 “가입신청자”라 합니다)가 이 약관의 내용에 대하여 동의를 한 다음 서비스 이용 신청을 하고, 회사가 그 신청에 대해서 승낙함으로써 체결됩니다.

② 회사는 가입신청자의 신청에 대하여 승낙함을 원칙으로 합니다.

③ 회사는 이용자의 편의를 위하여 게임서비스에 대해 임시 이용자 기능을 제공할 수 있습니다.  임시 이용자 기능 이용 중 아래 각 호에 해당하는 경우 계정정보가 삭제되거나 기록을 확인할 수 없는 문제가 발생할 수 있으며, 임시 이용자 기능을 통해 이용하던 게임서비스의 계정정보는 이후 연계 또는 이전이 불가할 수 있습니다. 이 경우 회사는 계정정보의 복구를 보장하지 않으며, 이에 대한 보상 및 손해배상에 대한 책임을 지지 않습니다. 단, 회사의 고의 또는 중과실에 의한 경우에는 그러하지 아니합니다. 

・모바일 기기를 변경한 경우

・모바일 기기를 개조하거나 초기화한 경우

・모바일 기기에서 어플리케이션 등 콘텐츠의 전부 또는 일부를 삭제한 경우

제 6 조 [약관 외 준칙] 

이 약관에서 정하지 아니한 사항과 이 약관의 해석에 관하여는 「전자상거래 등에서의 소비자보호에 관한 법률」,「약관의 규제에 관한 법률」,「게임산업진흥에 관한 법률」,「정보통신망이용촉진 및 정보보호 등에 관한 법률」,「콘텐츠산업진흥법」 등 관련 법령 또는 상 관례에 따릅니다.

제 7 조 [운영 정책]

① 약관을 적용하기 위하여 필요한 사항과 약관에서 구체적 범위를 정하여 위임한 사항을 게임서비스 운영정책(이하 “운영정책”이라 합니다)으로 정할 수 있습니다.

② 회사는 운영정책의 내용을 회원이 알 수 있도록 게임서비스 내 또는 그 연결화면에 게시합니다.

③ 운영정책을 개정하는 경우에는 제4조 제2항의 절차에 따릅니다. 다만, 운영정책 개정내용이 다음 각 호의 어느 하나에 해당하는 경우에는 본 조 제2항의 방법으로 사전에 공지합니다.

  1. 약관에서 구체적으로 범위를 정하여 위임한 사항을 개정하는 경우

  2. 회원의 권리·의무와 관련 없는 사항을 개정하는 경우

  3. 운영정책의 내용이 약관에서 정한 내용과 근본적으로 다르지 않고 회원이 예측할 수 있는 범위 내에서 운영정책을 개정하는 경우

제 8 조 [서비스의 제공 등]

① 회사는 이용자에게 아래와 같은 서비스를 제공합니다.

・ 게임 서비스 및 게임에 부수되는 부가 서비스

② 회사는 회사의 영업 방침에 따라 정해진 시간 동안 서비스를 제공합니다.

③ 회사는 이용자에게 서비스를 제공함에 있어 관련 법령, 이용자의 연령, 서비스의 이용 절차에 따라 일부 서비스 이용 등을 제한할 수 있습니다. 이 경우 회사는 그 내용을 사전에 안내합니다.

제 9 조 [개인정보의 보호 및 사용]

① 회사는 관련 법령이 정하는 바에 따라 회원의 개인정보를 보호하기 위해 노력하며, 개인정보의 보호 및 사용에 대해서는 관련 법령 및 회사의 개인정보처리방침에 따릅니다. 다만, 회사가 제공하는 서비스 이외의 링크된 서비스에서는 회사의 개인정보처리방침이 적용되지 않습니다.

② 회사는 관계 법령에 의해 관련 국가기관 등의 요청이 있는 경우를 제외하고는 회원의 개인정보를 본인의 동의 없이 타인에게 제공하지 않습니다.

③ 회사는 회원의 귀책사유로 유출된 회원의 개인정보 또는 계정정보 등으로 인해 발생한 피해에 대하여 책임을 지지 않습니다.

제 10 조 [정보의 수집 및 광고의 제공]

① 회사는 서비스의 원활하고 안정적인 운영 및 서비스 품질의 개선을 위하여(게임 재화, 스테이지 중간 저장 복구 등) 회원의 개인정보를 제외한 회원의 모바일 기기 정보(설정, 사양, 운영 체제, 버전 등)를 수집·활용할 수 있습니다.

② 회사는 기술적·통계적 분석 등을 위하여 회사가 필요하다고 판단하는 경우에만 한정하여 해당 정보를 열람합니다. 

또한 현행 법령 위반행위 및 이 약관 제15조에서 정하는 중대한 약관위반 행위의 조사, 처리, 확인 및 이의 구제와 관련하여 해당 정보를 열람해야 할 필요가 있는 경우에는, 해당 정보가 열람된 개인들에 대하여 열람한 사유와 열람한 정보 중 본인과 관련된 부분을 사후에 고지할 수 있습니다.

제 11 조 [서비스의 이용]

① 이용자는 이동통신사의 무선인터넷, 오픈마켓 스토어, 어플리케이션 스토어, 온라인 사이트 통하여 회사가 제공하는 서비스를 네트워크를 이용하여 무료 또는 유료로 이용할 수 있습니다.

② 이용자가 이동통신사의 무선인터넷 및 오픈 마켓 스토어, 어플리케이션 스토어를 통하여 구매하거나 네트워크 서비스를 이용하는 경우 이동통신사에서 정하는 소정의 데이터 통화료가 부과될 수 있습니다.

③ 유료 콘텐츠의 경우에는 해당 서비스에 명시된 요금을 지급하여야 이용할 수 있습니다. 네트워크를 통해 어플리케이션을 다운로드하거나 서비스를 이용하는 경우에는 가입한 이동통신사에서 정한 별도의 요금이 발생할 수 있습니다.

④ 다운로드하여 설치한 어플리케이션 또는 네트워크를 통해 이용하는 서비스의 경우에는 백그라운드 작업이 진행될 수 있습니다. 이 경우 모바일 기기 또는 이동통신사의 특성에 맞도록 추가요금이 발생할 수 있으며 이와 관련하여 회사는 책임을 지지 않습니다.

⑤ 회사는 각 서비스 이용에 필요한 최소한의 기술 사양 정보를 각 서비스별 홈페이지 또는 공식카페를 통해 제공합니다. 회원은 각 서비스 이용을 위해 서비스에 이용할 단말기 사양, 유무선 통신망의 품질 등이 해당 서비스 이용에 적합한지 여부를 확인하여야 합니다. 서비스 업데이트와 기술 발전 등의 환경 변화로 서비스 이용에 필요한 기술 사양 정보가 변경될 수 있으며, 회사는 기술 사양 정보의 변경으로 인한 책임을 부담하지 않습니다.

제 12 조 [유료 콘텐츠의 이용]

① 서비스 내에서 유료 결제를 통해 지급된 콘텐츠는 회원의 계정 정보에 귀속되어 해당 계정으로 로그인한 모바일 기기에서 사용할 수 있습니다. 다만, 임시 이용자의 경우 애플리케이션을 다운로드 받거나 설치한 디바이스에서만 이용할 수 있습니다.

② 회사는 서비스 중 회원에게 게임에서 사용할 수 있는 재화, 아이템(이하, “아이템”)을 유료 또는 무료로 구분하여 제공할 수 있으며, 유료 아이템의 사용 기간 관련 정책은 다음을 따릅니다.

 ・아이템은 구매일로부터 1년 이내 사용이 가능하며, 1년 이내 사용이 개시되지 않은 아이템은 소멸될 수 있습니다. 패키지 아이템은 패키지의 개봉을 사용의 개시로 봅니다.

 ・사용이 개시된 아이템 중 사용 기간이 표시되지 않은 유료 아이템(이하 ‘무기한 아이템’ 이라 함)은 사용 개시 시점부터 게임 서비스가 계속되는 동안 사용할 수 있으며, 제13조 2항에 따라 서비스가 중단되는 경우, 서비스 중단 공지 시 공지된 서비스의 중단일자까지를 사용 기간으로 합니다. 보증 기간이 경과되거나 서비스가 종료되는 경우 그 사용권은 상실될 수 있습니다. 이용자가 게임이나 어플리케이션 내 네트워크 서비스를 이용하여 아이템 등을 구매하는 경우에는 추가적인 요금이 발생할 수 있습니다.

③ 이용자가 구매한 콘텐츠는 획득 방식에 따라 유/무료 속성으로 구분되며, 이를 포함한 보유 콘텐츠 중 일부를 사용하였을 경우 유료 속성이 우선 차감되고, 그 이후 무료 속성이 차감됩니다. 다만, 서비스에서 별도의 사용 우선순위를 지정한 경우에는 그러하지 아니합니다.

④ 이용자가 구매한 콘텐츠는 기본적으로 다운로드 받거나 설치한 디바이스에서만 이용할 수 있습니다. 단, 오픈마켓 스토어 및 어플리케이션 스토어 등의 특성에 따라 계정 공유로 디바이스를 변경하여 사용할 수 있는 경우에는 해당 스토어의 정책에 따릅니다. 기기변경, 번호변경, 해외로밍 등을 하는 경우에는 콘텐츠의 전부 또는 일부 기능을 이용할 수 없을 수 있으나 이 경우 회사는 어떠한 책임도 부담하지 않습니다.

제 13 조 [서비스의 변경 및 중지]

① 회사는 운영상 또는 기술상의 필요에 따라 제공하고 있는 서비스를 변경할 수 있습니다. 변경될 서비스의 내용 및 제공일자 등에 대해서는 사전에 공지합니다. 단, 회사가 사전에 공지할 수 없는 치명적인 버그 발생, 서버기기결함, 긴급 보안문제 해결 등의 부득이한 사정이 있는 경우는 사후에 공지할 수 있습니다.

② 회사는 게임의 기획이나 운영상 또는 회사의 긴박한 상황 등에 의해 서비스 전부를 중단할 필요가 있는 경우 30일 전에 중단 일자, 중단 사유, 보상 조건 등을 게임 내 또는 개별 서비스 관련 공식카페 등에 이를 공지합니다. 이용자가 무료로 획득한 콘텐츠 및 서비스 종료 시 사용 기간이 남아 있지 않은 유료 정액제 또는 기간제 유료아이템, 사용이 종료되었거나 제 11조 2항에 따른 사용 기간이 남아 있지 않은 유료 콘텐츠에 대하여 환불, 손해 배상 등의 책임을 지지 않습니다.

③ 회사는 서비스의 변경 및 중지로 발생하는 문제에 대해서는 회사의 고의 또는 중과실이 없는 한 책임을 지지 않습니다.

제 14 조 [회사의 의무]

① 회사는 관련법령 및 본 약관에서 정하는 권리의 행사 및 의무의 이행을 신의에 따라 성실하게 준수합니다.

② 회사는 회원이 안전하게 서비스를 이용할 수 있도록 개인 정보(신용 정보 포함) 보호를 위해 보안 시스템을 갖추어야 하며, 개인정보처리방침을 공시하고 준수합니다.

③ 회사는 계속적이고 안정적인 서비스의 제공을 위하여 서비스 개선을 하던 중 설비에 장애가 생기거나 데이터 등이 멸실․훼손된 때에는 천재지변, 비상사태, 현재의 기술로는 해결이 불가능한 장애나 결함 등 부득이한 사유가 없는 한 지체 없이 이를 수리 또는 복구하도록 최선의 노력을 다합니다.

제 15 조 [이용자의 의무]

① 이용자는 회사가 제공하는 서비스를 이용함에 있어 다음 각 호의 행위 또는 다음 각호에 해당 하는 내용을 목적으로 하거나 의도하는 행위를 하여서는 안됩니다.

  1. 다른 이용자의 ID 및 비밀 번호 또는 타인의 핸드폰 번호를 포함한 타인의 개인정보를 도용, 부정하게 사용

  2. 회사가 제공하지 않는 서비스를 통해 게임 ID에 축적된 게임 아이템, 게임 머니 등을 타인과 거래, 매매

  3. 회사의 서비스 또는 서비스를 이용하여 얻은 정보를 회사의 사전 승낙 없이 복제, 유통, 조장하거나 상업적으로 이용

  4. 회사의 서비스를 이용하여 자기 또는 타인에게 재산상의 이익을 발생

  5. 서비스를 무단으로 영리, 영업, 광고, 홍보, 정치활동, 선거운동 등 본래의 용도 이외의 용도로 이용하는 행위

  6. 타인의 명예를 훼손하거나 손해를 가하는 행위

  7. 타인의 신용카드⋅유/무선 전화⋅은행 계좌 등을 도용하여 콘텐츠를 구매하는 행위, 다른 회원의 ID 및 비밀번호를 부정사용하는 행위

  8. 회사의 지적재산권, 제3자의 지적재산권, 초상권 등 기타 권리를 침해

  9. 회사의 승인을 받지 않고 다른 이용자의 개인정보를 수집, 저장, 유포, 게시

  10. 프로그램의 버그를 악용하거나 서비스와 관련된 설비의 오동작이나 정보 등의 파괴 및 혼란을 유발시키는 컴퓨터바이러스 감염자료를 등록 또는 유포

  11. 회사로부터 특별한 권리를 부여 받지 않고 애플리케이션을 변경하거나, 애플리케이션에 다른 프로그램을 추가⋅삽입하거나, 서버를 해킹⋅역설계하거나, 소스 코드나 애플리케이션 데이터를 유출⋅변경하거나, 별도의 서버를 구축하거나, 웹사이트의 일부분을 임의로 변경⋅도용하여 회사를 사칭하는 행위

② 회원의 계정 및 모바일 기기에 관한 관리 책임은 회원에게 있으며, 이를 타인이 이용하도록 하게 하여서는 안 됩니다. 모바일 기기의 관리 부실이나 타인에게 이용을 승낙함으로 인해 발생하는 손해에 대해서 회사는 책임을 지지 않습니다.

③ 회원은 각 오픈마켓에서 부정한 결제가 이루어지지 아니하도록 결제 비밀번호 기능을 설정하고 관리하여야 합니다. 회원의 부주의로 인하여 발생하는 손해에 대해 회사는 책임지지 않습니다.

제 16 조 [저작권의 및 이용제한]

① 회사가 작성한 저작물에 대한 저작권 및 기타 지적재산권은 회사에 귀속합니다.

② 이용자가 서비스 내에 게시한 게시물의 저작권은 해당 저작권자에게 귀속합니다.

③ 이용자는 서비스를 이용하면서 얻은 정보 중 회사 또는 제공 업체에 지적 재산권이 귀속된 정보를 회사 또는 제공 업체의 사전 동의 없이 복제⋅전송 등의 방법(편집, 공표, 공연, 배포, 방송, 2차적 저작물 작성 등을 포함합니다. 이하 같습니다)에 의하여 영리목적으로 이용하거나 제3자에게 이용하게 하여서는 안됩니다.

④ 이용자가 서비스 내에 게시하는 게시물은 검색결과 내지 서비스 및 관련 프로모션 등에 노출될 수 있으며, 해당 노출을 위해 필요한 범위 내에서는 일부 수정, 복제, 편집되어 게시될 수 있습니다. 이 경우, 회사는 저작권법의 내용을 준수하여야 하며, 이용자는 언제든지 고객센터 또는 서비스 내 관리기능을 통해 해당 게시물에 대해 삭제, 검색 결과 제외, 비공개 등의 요청 할 수 있습니다. 이 경우 회사는 신속하게 필요한 조치를 취하고, 이를 신청인에게 통지합니다.

⑤ 회사는 이용자의 게시물이 제3자로부터 저작권 등의 문제로 이의제기가 있고 그것이 상당한 이유가 있다고 판단되는 경우, 사전 통지 없이 이를 삭제하거나 등록 자체를 거부할 수 있으며, 저작권 및 권리침해로 인한 게시물의 게시중단 등에 대한 사항은 저작권법 및 관계법령에 따릅니다.

⑥ 이는 회사가 서비스를 운영하는 동안 유효합니다.

제 17 조 [커뮤니티 서비스]

① 커뮤니티 서비스는 다수의 이용자가 자유롭게 의사를 교환하고 친목을 도모할 수 있도록 회사가 제공하는 게시판 등의 서비스를 말합니다.

② 커뮤니티 서비스가 제휴 서비스 와 연동되어 제공되는 경우에는, 회원이 각 제휴 서비스의 회원 자격을 상실하거나 탈퇴 시 정상적으로 커뮤니티 서비스의 제공이 이루어지지 않을 수 있습니다.

③ 회사는 회원의 권익 보호와 건전한 커뮤니티 서비스 제공을 위하여 필요한 사항을 운영정책 내 포함하거나 별도의 정책으로 정할 수 있으며, 회원은 이를 준수할 의무가 있습니다. 회사는 운영정책 또는 별도 정책의 내용을 회원이 알 수 있도록 서비스 또는 커뮤니티 서비스 내 게시하거나 연결화면을 제공하는 방법으로 회원에게 공지합니다.

제 18 조 [이용자의 게시물]

① 이용자의 게시물로 인해 발생하는 손실이나 문제는 이용자 개인의 책임이며 회사는 이에 대한 책임을 지지 않습니다.

② 이용자가 게시하거나 전달하는 게시물이 다음의 각 호에 해당한다고 판단되는 경우 회사는 사전 통지 없이 삭제시킬 수 있으며 또한 등록을 거부할 수 있습니다.

  1. 다른 이용자나 타인을 비방하거나, 프라이버시를 침해하거나, 중상모략으로 명예를 손상시키는 내용인 경우

  2. 서비스의 안정적인 운영에 지장을 주거나 줄 우려가 있는 경우

  3. 범죄적 행위에 관련된다고 인정되는 내용일 경우

  4. 회사 및 제 3자의 지적재산권 등 기타 권리를 침해하는 내용인 경우

제 19 조 [대금결제]

① 콘텐츠에 대한 구매 대금 부과와 납부는 원칙적으로 이동통신사와 어플리케이션 스토어, 온라인사이트에서 정하는 방법, 정책 등에 따릅니다. 또한, 각 결제 수단별 한도가 회사나 오픈 마켓 사업자가 정하는 정책 또는 정부의 방침에 따라 부여되거나 조정될 수 있습니다.

② 회사의 정책 및 결제업체 (이동통신사, 오픈마켓 스토어, 어플리케이션 스토어 등)의 정책, 정부의 방침 등에 따라 각 결제 수단별로 결제 한도가 부여될 수 있습니다.

③ 콘텐츠의 구매대금을 외화로 결제하는 경우에는 환율‧수수료 등으로 인하여 실제 청구금액이 서비스의 상점 등에서 표시된 가격과 달라질 수 있습니다.

제 20 조 [청약 철회]

① 회사가 회원에게 제공하는 유료 콘텐츠는 청약 철회가 가능한 콘텐츠와 청약철회가 제한되는 콘텐츠로 구분되어 제공됩니다. 유료로 직접 구매하여 청약철회가 가능한 유료 콘텐츠에 대해서는 구매 후 7일 기간 내에 청약 철회를 할 수 있습니다.

② 회원은 다음 각 호에 해당하는 경우에는 청약철회가 제한될 수 있으며, 이 경우 회사는 관련 법령에서 정한 바에 따른 조치를 취합니다.

 ・무상으로 제공 받은 콘텐츠

 ・구매 후 즉시 사용이 시작되거나 게임 서비스에 바로 적용되는 콘텐츠의 경우

 ・추가혜택이 제공되는 경우에 그 추가 혜택이 사용된 콘텐츠

③ 회사는 제2항 각 호의 규정에 따라 청약철회가 불가능한 콘텐츠의 경우에는 그 사실을 회원이 쉽게 알 수 있는 곳에 명확하게 표시하고, 해당 콘텐츠의 시험사용 상품을 제공(한시적 이용의 허용, 체험용 제공 등)하거나 이에 대한 제공이 곤란한 경우에는 콘텐츠에 관한 정보 제공함으로써 회원의 청약철회의 권리행사가 방해받지 아니하도록 조치합니다. 만약 회사가 이러한 조치를 하지 아니한 경우에는 제2항 각 호의 청약철회 제한사유에도 불구하고 회원은 청약철회를 할 수 있습니다.

④ 회원은 제1항 및 제2항에도 불구하고 구매한 유료 콘텐츠의 내용이 표시․광고의 내용과 다르거나 구매계약의 내용과 다르게 이행된 경우에 해당 콘텐츠가 이용 가능하게 된 날부터 3개월 이내, 그 사실을 안 날 또는 알 수 있었던 날부터 30일 이내에 청약철회를 할 수 있습니다.

⑤ 회원이 청약철회를 할 경우 회사는 오픈마켓 사업자를 통해 구매내역을 확인할 수 있습니다.

⑥ 미성년자가 법정대리인의 동의 없이 구매계약을 체결한 때에는 미성년자 본인 또는 법정대리인은 회사에 그 계약을 취소할 수 있습니다. 다만, 미성년자가 법정대리인이 범위를 정하여 처분을 허락한 재산으로 콘텐츠를 구매한 경우 또는 미성년자가 속임수로써 자기를 성년자로 믿게 하거나 법정대리인의 동의가 있는 것으로 믿게 한 경우에는 취소할 수 없습니다.

제 21 조 [과오납금의 환급]

① 유료 결제는 오픈마켓사업자가 제공하는 결제방식에 따르며, 결제 과정에서 과오금이 발생하는 경우 회사 또는 오픈마켓사업자에게 환급을 요청하여야 합니다. 다만, 오픈마켓 사업자의 정책, 시스템에 따라 회사가 오픈마켓 사업자에게 필요한 환급 절차의 이행을 요청할 수도 있습니다.

③ 구글 플레이, 애플 앱스토어의 경우 회원은 직접 환급을 신청 하여야 합니다.

④ 애플리케이션의 다운로드 또는 네트워크 서비스의 이용으로 인해 발생한 통신요금(통화료, 데이터 통화료 등)은 환급 대상에서 제외될 수 있습니다.

⑤ 회원이 유료 결제를 통하지 않고 서비스 이용 중 무상으로 취득하거나, 회사가 내부 혹은 외부 제휴 이벤트 등을 통하여 무상으로 제공한 콘텐츠는 환급대상에 제외됩니다.

제 22 조 [계약 해지]

① 회원은 언제든지 서비스 이용을 원하지 않는 경우 계정삭제를 통해 이용계약을 해지할 수 있습니다. 계정삭제로 인해 회원이 게임서비스 내에서 보유한 게임이용정보는 모두 삭제되어 복구가 불가능하게 됩니다.

제 23 조 [손해배상]

① 이용자가 본 약관의 규정을 위반함으로 인하여 회사에 손해가 발생하게 되는 경우, 이 약관을 위반한 이용자는 회사에 발생하는 손해를 배상할 책임이 있습니다. 다만 회사에게 귀책사유가 있는 부분은 회사가 책임을 부담합니다.

② 이용자가 서비스를 이용함에 있어 행한 불법행위나 본 약관 위반행위로 인하여 회사가 당해 이용자 이외의 제3자로부터 손해배상 청구 또는 소송을 비롯한 각종 이의제기를 받는 경우 당해 이용자는 자신의 책임과 비용으로 회사를 면책시켜야 하며, 회사가 면책되지 못한 경우 당해 이용자는 그로 인하여 회사에 발생한 손해를 배상할 책임이 있습니다. 단 회사에게 귀책사유가 있는 부분은 회사가 책임을 부담합니다.

제 24 조 [회사의 면책]

① 회사는 천재지변 또는 이에 준하는 불가항력으로 인하여 서비스를 제공할 수 없는 경우에는 서비스 제공에 관하여 책임을 지지 않습니다.

② 회사는 서비스용 설비의 보수, 교체, 정기점검, 공사 등 기타 이에 준하는 사유로 발생한 손해에 대하여 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.

③ 회사는 무료로 제공되는 서비스 이용과 관련하여 회원에게 발생한 손해에 대해서는 책임을 지지 않습니다. 다만, 회사의 고의 또는 중과실에 의한 경우에는 그러하지 아니합니다.

④ 회사는 회원의 게임정보 (경험치, 등급, 아이템, 게임머니 등)의 손실에 대하여 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.

⑤ 회원은 모바일 기기의 비밀번호 설정 기능, 오픈마켓이 제공하는 비밀번호 설정 기능 등을 관리하지 않아 발생하는 제3자 결제에 대해 책임지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.

⑥ 모바일 기기의 변경, 휴대전화번호 변경, 운영체제(OS)의 업그레이드 및 변경, 해외 로밍, 통신사 변경 등으로 인해 콘텐츠의 전부 또는 일부 기능을 이용할 수 없는 경우 회사는 이에 대해 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.

⑦ 회원이 회사에서 제공하는 콘텐츠 또는 계정정보를 삭제한 경우 회사는 이에 대해 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.

⑦ 회사는 임시회원이 서비스 이용으로 발생한 손해에 대해서는 책임을 지지 않습니다. 다만, 회사의 고의 또는 과실에 의한 경우에는 그러하지 아니합니다.

제 25 조 [재판권 및 준거법]

이 약관은 대한민국 법률에 따라 규율되고 해석됩니다. 회사와회원 간에 발생한 분쟁으로 소송이 제기되는 경우에는 법령에 정한 절차에 따른 법원을 관할 법원으로 합니다.

제 26 조 [회원의 고충처리 및 분쟁해결]

① 회사는 회원의 편의를 고려하여 회원의 의견이나 불만을 제시하는 방법을 게임서비스 내 또는 공식 카페에 안내합니다. 회사는 이러한 회원의 의견이나 불만을 처리하기 위한 전담인력을 운영합니다.

We collect information when you provide it to us and when you use the Services. We also may collect information about you from other sources.

When you register, contact directly, or otherwise use the Services, you may choose to provide information to us, including:

① To ensure smooth and reliable operation of the service and to improve the quality of the service (game goods, stage storage recovery, etc.) the member’s mobile device information (setups, specifications, operating systems, versions), excluding the member’s personal information

② Payment information, which our payment processors collect when you make purchases.

2. HOW WE USE INFORMATION

We may use, record, systematize, store, update or modify, retrieve, delete, or otherwise process your information for the following purposes, using manual or automated means: 

Our payment processors use payment information as necessary to complete transactions or as otherwise required by law. We also may use the information we collect to:

① Provide the Services and deliver requested products and information, including technical support and responses to your questions or comments.

② Analyze and address prohibited activities, including by assisting our efforts in policing users who may develop or use hacks or cheats to gain advantage over other users of the Services, and to otherwise enforce our Terms of Service and End User License Agreement.

PuzzleSpace’s legal bases to process information for these purposes include that the processing is necessary for:

① PuzzleSpace’s legitimate interests, including those described above and as necessary to provide the Services.

② Compliance with PuzzleSpace’s legal obligations. 

③ The performance of the Terms of Service between PuzzleSpace and the user.

④ Carrying out the obligations and exercising rights under applicable law.

⑤ Where applicable, on the basis of the consent of users which may subsequently be withdrawn at any time by contacting us, without affecting the lawfulness of processing based on consent before its withdrawal. We rely on consent for certain advertising purposes, the combination of data across devices, and international transfers of personal information. For more information on how you can provide or withdraw your consent, see your choices.

3. WHEN INFORMATION IS SHARED

We limit when we share the information we collect to the following circumstances:

Business Partners: We share information with service providers, including payment processing and gateway companies, platform services to help us provide and improve the Services and operate our business 

Legal Purposes. We may provide your information to third parties when we believe that doing so is required by law or to cooperate with regulators or law enforcement authorities. We may disclose your information in order to protect the rights or property of PuzzleSpace , including enforcing our Terms of Service and End User License Agreement, and others, or when we believe that there is an emergency that poses a threat to the health or safety of you, another person, or the public. 

With Your Consent. We may share information for any other purposes disclosed to you at the time we collect the information or pursuant to your consent 

4. YOUR CHOICES

Geolocation Information: Your device may enable you to control the collection of your precise geolocation information 

Request data rights and correction, deletion : The laws in your country may provide you rights to request access to, correct, restrict, port, copy, or delete your information, request that we stop processing your information or delete your account, or withdraw or change the scope of your consent. If you withdraw your consent, we will stop processing your information for such purposes, but it will not affect the processing of information previously covered by your consent. Where technologically feasible and required by applicable law, we will port your information pursuant to your reasonable request. A request to withdraw consent, restrict or stop processing your information, or delete your account or information may result in your inability to access the Services or some of its features. To exercise your rights consistent with applicable law, please contact us.

5. CHILDREN

We do not knowingly collect personal information from children who are under the age of 13 (or the age otherwise defined under applicable law) without parental consent or unless permitted by applicable law.

6. California

① We provide registered users the ability to post information on our Services. If you are a California resident who is under 18 and a registered user and you are unable to remove content or information you posted in a public area following the instructions provided, you may request removal by contacting us. When requesting removal you must be specific about the information or content you want to remove and provide the URL for each place it is located. We are not required to remove any content or information that: (a) we, or a third party, are legally required to maintain; (b) was not posted by you; (c) is anonymized so that you cannot be identified; (d) is not based on a request that follows our instructions for removing or requesting removal; or (e) you received compensation or other consideration for providing the content or information.

7. No personal information automated collection devices.

We does not operate a device that automatically collects personal information when using Internet services such as cookies.

While we take reasonable precautions against possible loss, misuse, or unauthorized access, no storage system or transmission of data over the Internet can be guaranteed to be secure. 9. INTERNATIONAL DATA TRANSFERS

1. USE OF THE SERVICES

Limited License: Subject to these Terms, you may access and use the Services running operating systems on which the Services were designed to operate for your personal, non-commercial, entertainment use only. The Services are licensed, not sold, to you on a limited, revocable, non-sublicensable, nontransferable, and non-exclusive basis. You may not modify, copy (except for a single backup copy and transient copying required to operate the Services), distribute, transmit, display, perform, reproduce, publish, create derivative works from or adapt, sell, rent, lease, sublicense, or otherwise transfer or make available the Services or any portion thereof. Without limiting the generality of the foregoing, you agree that you have no right to sell or otherwise transfer any of the virtual items, virtual currency or any other content or information from the Services, in whole or in part, on internet auction sites (such as eBay or IGE), hack sites, private server sites, gold farming sites, or any other third-party sites or services or in return for anything of value (whether real money or otherwise). You have no rights in or to the Services unless expressly granted to you under these Terms. Your license is automatically rescinded and terminated if you breach any provision of the Terms.

Additional Terms: Some of the Services are subject to and governed by additional terms, conditions, rules, or guidelines on permissible use (“Additional Terms”). We will make these Additional Terms available to you through the applicable service, in which case your acceptance of such Additional Terms is required before you may use the applicable service. If any of the covenants of this agreement conflict with any terms and conditions of Additional Terms, the Additional Terms shall supersede this agreement with respect to the subject matter addressed in the Additional Terms.

Eligibility: You represent that you are not a person barred from receiving the Services under applicable law. You also represent that you either are over the age of majority in your country or, consistent with applicable law, use the Services only with the permission and under the supervision of a parent or legal guardian that has reviewed and agreed to these Terms. Children (as defined under applicable law) may not register for an account and may not provide any personal information to PuzzleSpace or others through the Services.

Account Registration: Some of our Services require you to create an account with us. If you are not signed into your account, you might not be able to access some portions or features of the Services. When creating an account, you will provide only accurate and complete information, and promptly update this information. You will keep your e-mail and password confidential and secure, and will not use the same password that you use for other websites or services. You will uninstall and delete the Services before transferring any device on which they are installed. You will immediately notify us if you discover or otherwise suspect any unauthorized access to or use of your account.

NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN YOUR ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF PuzzleSpace. We do not recognize or allow the transfer of accounts between players. You may not, and may not offer to, purchase, sell, gift, or trade any account. Any such attempt shall be null and void and may result in the termination and forfeiture of the account.

Updates: PuzzleSpace may provide you with updates as they are made generally available by PuzzleSpace in its sole discretion. You acknowledge and agree that PuzzleSpace may provide updates to you remotely and automatically, including by (without limitation) accessing the device on which you use the Services. Any updates provided or made available by PuzzleSpace are part of the Services and will be subject to these Terms.

Export Controls: You will abide by all applicable export laws and regulations when using the Service. The Services, or any part thereof, may not be downloaded or otherwise exported or re-exported (a) into any country for which the United States has a trade embargo, or (b) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Commerce Department’s Table of Denial Orders or subject to EU or EU member state financial or other sanctions. You represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.

Cross-border Transfers:  By accepting these Terms you understand and agree that performance of these Terms and provision of the Services may require transfer of the information that we collect from your country to other countries, which may not provide the same level of protection as the European Union/European Economic Area or your home country.

2. CONTENT POSTED BY USERS

You are and will remain solely responsible for all communications, images, videos, sounds, content or part of the content of databases, databases, content and any other materials or information that you upload or transmit through the Services, including without limitation any text, voice transmissions or recordings, or gameplay clips (“User Content”).

You represent and warrant that the User Content that you post or transmit will not:

• Infringe the copyright, trademark, database or other intellectual property rights of a third party. You represent and warrant that you own or have all necessary licenses, rights, consents, and permissions to post or transmit the User Content on the Services and that the User Content does not violate any applicable laws, the Terms, or any third party’s right of privacy or publicity. 

• Promote unauthorized sweepstakes or contest; and will not promote a lottery, or gambling of any type. 

• Prevent or impede other users from finding information related to the Services. 

• Facilitate or promote conduct that in the sole discretion of PuzzleSpace involves illegal content, pornography, piracy, online pharmacies, illegal drugs, underage drinking, or socially irresponsible behavior due to alcohol or drug consumption (such as drinking and driving). 

• Instruct users how to make bombs, weapons, drugs, illegal or illicit or dangerous items, or solicit involvement in behavior or organizations that are violent or illegal under applicable laws, including without limitation terrorist threats or activities .

You acknowledge and agree that PuzzleSpace may (but is not required to) moderate, monitor, review, and record any User Content (including the content of your oral or written communications) that you post, transmit, or make available on or through the Services and may, without prior notice to you and in its sole judgment, remove User Content for any or no reason, at any time. You agree that such monitoring or recording can be made using software that may be installed when you download software to access or use the Services. Unless required by law, PuzzleSpace assumes no liability for any failure to remove, or any delay in removing, User Content and does not assume any responsibility or liability for the use and/or storage of User Content. 

You hereby grant PuzzleSpace a royalty-free, perpetual, irrevocable, fully transferable and sublicensable, non-exclusive, worldwide right and license to use your User Content in any and all media in any manner and for any purpose (including without limitation commercial, advertising, and promotional purposes) to the greatest extent permitted by applicable law, including without limitation the rights to reproduce, copy, modify, perform, display, publish, distribute, broadcast, transmit, or otherwise communicate to the public, or create derivative works from or adapt, use or otherwise exploit by any means whether now known or unknown and without any further notice or compensation to you of any kind. To the extent permitted by applicable law, you waive any moral rights of paternity, publication, reputation, or attribution with respect to PuzzleSpace’s and other players’ use and enjoyment of User Content in connection with the Services. The license grant to PuzzleSpace, and the above waiver of any applicable moral rights, survives any termination or expiration of the Terms.

3. INTELLECTUAL PROPERTY AND CLAIMS OF INFRINGEMENT

The Services (including any updates thereto) are protected under the copyright and other intellectual property laws of the United States, European Union, and other countries. PuzzleSpace and our associated logos and names are our trademarks and/or service marks. Other trademarks, service marks, names, and logos used on or through the Services are the trademarks, service marks or logos of their respective owners. You are granted no right or license with respect to any of these trademarks, service marks, or logos without our prior written consent. PuzzleSpace owns and shall retain all right, title, and interest, including without limitation all intellectual property rights, in and to the Services and any portions thereof.

PuzzleSpace is always pleased to hear from our players and fans, and we welcome comments and feedback regarding our Services. Any ideas, suggestions, proposals, comments, feedback, or other submissions (including without limitation those that provide feedback on our Services or suggest new content, features, products, or similar ideas) (collectively, “Feedback”), regardless of whether you provide such Feedback in a public or private medium, will not be treated as confidential or proprietary. This means that if you provide Feedback to PuzzleSpace, you are waiving all rights to it and are allowing it to be shared and used by us or others for any purpose, including without limitation using, sharing, and commercially exploiting the Feedback any way we see fit without any notice or compensation to you. PuzzleSpace does not return or regularly acknowledge Feedback we receive, and does not have any obligation related to your Feedback.

We respect the intellectual property rights of others. If you have a good faith belief that your copyrighted work or other intellectual property has been infringed and is accessible through our Services, you may notify our Designated Agent by contacting us as specified below by providing the following information in writing:

• Identification of the copyrighted work or intellectual property, or a representative list of works or property claimed to have been infringed.

• Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate the material.

• Your name, address and daytime telephone number, and an e-mail address if available, so that we may contact you if necessary.

• A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

• A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the owner of the intellectual property, its agent, or the law.

• A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

If the content is removed, the party that posted the content may receive a notice that it was removed because of claimed infringement. We may provide them with your contact information, including email address and the name of your organization or client, and the contents of your report. If the party that posted the content believes that the content shouldn’t have been removed, they’ll be encouraged to reach out to you to try to resolve the issue directly, and they may be able to submit a counter-notification under applicable law. We terminate the privileges of users who repeatedly infringe intellectual property laws.

4. VIRTUAL CURRENCY AND VIRTUAL ITEMS

While using the Services, you may have the opportunity to visit in-game stores where you can obtain and use PuzzleSpace’s virtual currency and digital, in-game items (including early access to games still in production, as may be offered from time to time). 

VIRTUAL CONTENTS, INCLUDING VIRTUAL CONTENTS EXCHANGED FOR PREPAID PAYMENT INSTRUMENTS, ARE REGARDED AS GOODS OR SERVICES, AND ARE NOT PREPAID PAYMENT INSTRUMENTS. Virtual currency and points have no “real-world” value but may be exchanged for in-game items. Items from such stores are not purchased by you, but rather are licensed to you under these Terms. REGARDLESS OF THE CONSIDERATION OFFERED OR PAID IN EXCHANGE FOR VIRTUAL CURRENCY, YOU DO NOT HAVE ANY OWNERSHIP RIGHTS IN THE ITEMS OBTAINED WITH VIRTUAL CURRENCY.

Any prices, quotations and descriptions made or referred to on our Services do not constitute an offer and may be withdrawn or revised at any time before PuzzleSpace’s express acceptance of your order. To the extent permitted under applicable law, you agree to pay all charges, fees, and applicable taxes incurred by you or anyone else using your account or resulting from use of the Services on your device at the price(s) in effect when such charges occurred. PuzzleSpace may change the pricing for the Services at any time consistent with applicable law. PuzzleSpace reserves the right to notify you of any mistakes in product descriptions or errors in pricing prior to product dispatch. If that happens, and you choose to continue with fulfilment of the order, you acknowledge that the product or service will be provided in accordance with such revised description or corrected price.

Different payment methods, such as credit card, direct debit, PayPal, Karma Koin, etc., may be available to you when obtaining virtual currency through the Services. When you use third-party payment and billing providers, such as PayPal, that provider’s additional terms, conditions, and costs, apply. It is your obligation to pay all federal, state, and local taxes associated with the receipt or use of the virtual items which you purchase from PuzzleSpace.

Certain minimums may apply to purchases of virtual currency, and certain maximums may apply depending on your transaction method. PuzzleSpace reserves the right to change the maximum and minimum amounts applicable to virtual currency purchases at any time without notice, consistent with applicable law.

YOU UNDERSTAND AND AGREE THAT PUZZLESPACE WILL NOT OFFER REFUNDS FOR VIRTUAL CURRENCY OR DIGITAL, IN-GAME ITEMS UNDER ANY CIRCUMSTANCES, INCLUDING WITHOUT LIMITATION TERMINATION OR EXPIRATION OF YOUR ACCOUNT, THESE TERMS, OR THE SERVICES, EXCEPT AS EXPRESSLY REQUIRED BY APPLICABLE LAW. If an account is permanently banned, all content licenses and virtual currency balances associated with the suspended account are forfeited. PuzzleSpace will have no obligation or responsibility to and will not reimburse you for any virtual currency, points, items, or experience lost due to your violation of these Terms.

Items may expire. Each item that you obtain using virtual currency or points will be included in your account until the earlier of the item’s expiration date, termination or expiration of your account, these Terms, or the Services. Price and availability of items are subject to change without notice, consistent with applicable law.

Notwithstanding these Terms, the laws in your country may apply to the purchase of virtual goods and services supplied by PuzzleSpace to you and you may have rights or remedies as set out in such laws that apply in addition to, or, to the extent that they are inconsistent, instead of, the rights or remedies set out in these Terms.

As for the Services provided in Japan, only virtual contents or in-game items that are shown as Prepaid Payment Instruments on the websites titled “Representation in accordance with the Payment Services Act in Japan” or “Prepaid Payment Instruments” shall be deemed as “Prepaid Payment Instruments” under the Payment Services Act in Japan. All other virtual contents or in-game items to be exchanged for by such “Prepaid Payment Instruments” are considered to be goods or services delivered in the game and are not considered as “Prepaid Payment Instruments” under the Payment Services Act. Unless otherwise provided for under the said Act, any “Prepaid Payment Instruments” shall not be refunded.

5. CODE OF CONDUCT

You will not use the Services in any manner that, in PuzzleSpace’s sole discretion, is unlawful or could damage, disable, overburden, or impair the Services or interfere with PuzzleSpace’s or any others’ use and enjoyment of the Services. Without limiting the generality of the foregoing, prohibited conduct includes the following, subject to applicable law:

• Using any hacks, cracks, bots, or third-party software that may modify, temporarily or permanently, the code or the user experience of the Services, whether locally on your device or on servers, or using any application, software or technology that is not expressly authorized by us that enables cheating, power-leveling, or accomplishing game tasks that cannot be accomplished without the use of such an application, software or technology.

• Reverse engineering, deriving source code, modifying, decompiling, disassembling the Services or any portion thereof, or otherwise determining or attempting to determine any source code, algorithms, methods or techniques used or embodied in the Services. 

• Impersonating any person or entity or otherwise misrepresenting your affiliation, identity, or the origin of materials you transmit, or misrepresenting that your statements or actions are endorsed by PuzzleSpace.

• Using any robot, spider, site search/retrieval application or other manual or automatic device or process to retrieve, index, data mine, or in any way reproduce or circumvent the navigational structure or presentation of the Services, or any content contained therein.

• Removing, altering, or concealing any copyright, trademark, patent or other proprietary notices, legends, symbols, or labels (including any watermark or other digital rights management technology or other information) contained on or within the Services. 

• Taking any action that imposes an unreasonable or disproportionately large load on our network or infrastructure.

• Hosting, providing, or developing matchmaking services for the Services without PuzzleSpace’s prior written approval or creating, using, or maintaining any unauthorized connections to the Services.

• Intercepting, emulating, or redirecting the communication protocols used by PuzzleSpace or its designees in any way, including without limitation through protocol emulation, tunneling, packet sniffing, modifying or adding components to software, use of a data mining utility program to intercept, collect, read or mine information generated by the Services, or in any way utilize a technique now known or hereafter developed that would allow for or otherwise make available unauthorized access or use of the Services.

• Using or attempting to use any viruses, malware, or any other computer code, files, programs, software, routine, or device designed to interrupt, destroy, or limit the functionality or proper working of the Services or PuzzleSpace’s systems or networks, including by engaging in, instigating, or facilitating any denial of service attack or similar conduct, or attempt to probe, scan, test the vulnerability of, or breach the security of any system or network.

• Using macros, auto-looting or robot play, or any other behavior that allows you (or any character you are controlling) to automatically function or effect any action in a game with or without your presence.

• Creating more than one account within twenty-four hours or more than five accounts within thirty days, or otherwise exceeding your authorized access to any portion of the Services or any database, computer, or device.

• Distributing unauthorized materials or advertising or promoting goods or services without our permission (including, without limitation, by sending spam, promotional materials, junk mail, chain letters, pyramid schemes or any other form of unauthorized solicitation).

• Engaging in conduct that is harmful, harassing, defamatory, vulgar, obscene, hateful, threatening, abusive, inflammatory, intimidating, discriminatory, violent or encouraging of violence (including self-harm), stalking, sexually explicit, or otherwise objectionable in PuzzleSpace’s sole discretion, including without limitation looting, kill stealing, making sexual comments, or cursing.

• Selling, advertising, or posting information on hacks, private servers (including sources thereof), or gold farming for the Services.

• Creating, utilizing, or transacting in any in-game item created or copied by exploiting a design flaw, undocumented problem, or program bug. 

• Publishing, or sharing in any way, the personal information of other users, or any material, non-public information about companies without the authorization to do so. 

• Engaging in any other conduct that, in PuzzleSpace’s sole judgment, exposes us, any of our users, or any other third party to any liability, damages, or detriment of any type.

Violations of system or network security or attempts to disrupt or undermine the operation of the Services may result in civil or criminal liability. We may investigate and work with law enforcement authorities to prosecute users who violate the Terms. 

WE MAY WITHHOLD, SUSPEND, MODIFY, OR TERMINATE YOUR ACCESS TO THE SERVICES FOR ANY OR NO REASON AT ANY TIME WITHOUT NOTICE UNLESS OTHERWISE REQUIRED BY APPLICABLE LAW. If your account is suspended while you are participating in a tournament or competition, PuzzleSpace assumes no liability in the loss of any potential prizes or recognition related to the tournament or competition. 

6. THIRD-PARTY SERVICES, CONTENT, AND NETWORKS

The Services may be made available to you through third-party services, such as Apple iTunes or Google Play, and may link to or include third-party services or content (including without limitation User Content posted in forums). We do not control, endorse, sponsor, recommend, or otherwise accept responsibility for such third-party services or content. These third parties may require you to install additional software, register for additional accounts, agree to additional terms and conditions, or take other actions before using the Services. Use of any third-party services or content is at your own risk and is subject to the third party’s terms and conditions. Under no circumstances will PuzzleSpace be responsible or liable in connection with your reliance on or use of third-party services or content.

When using our Services, your device may connect to or utilize third-party networks, and you may incur fees based on your use of those networks. You are solely responsible for any and all costs and fees in connection with accessing and using the Services, including without limitation internet service provider fees, telecommunications fees, text messaging fees, excess broadband fees, and the costs of any and all devices and equipment used in connection with the Services.

7. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

PUZZLESPACE AND ITS DEVELOPERS AND SERVICE PROVIDERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, ACCURACY, FITNESS, PERFORMANCE, OR INTEROPERABILITY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND ANY CONTENT CONTAINED WITHIN THE SERVICES FOR ANY PURPOSE. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. PUZZLESPACE AND ITS DEVELOPERS AND SERVICE PROVIDERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

YOU SPECIFICALLY AGREE THAT In no event will PuzzleSpace, OUR REPRESENTATIVES, MANAGERS, PARTNERS, SHAREHOLDERS, JOINT VENTURERS, THIRD-PARTY CONTRACTORS, EMPLOYEES, LICENSEES, LICENSORS, ADVERTISERS, OR AGENTS be liable for any direct or indirect, special, incidental, consequential, or punitive damages, lost profits, or other damages whatsoever arising in connection with the use of THE SERVICES, any interruption in availability of THE SERVICES, delay in operation or transmission, computer virus, loss of data, or use, misuse, reliance, review, manipulation, or other utilization in any manner whatsoever of THE SERVICES or the data collected through THE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, even if WE HAVE been advised of the possibility of such damages or loss. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL, INCIDENTAL, OR OTHER FORMS OF DAMAGES, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SERVICES, OR WITH ANY OF THE TERMS OF THE APPLICABLE AGREEMENTS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICES. THE MAXIMUM AGGREGATE LIABILITY OF PUZZLESPACE FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING, WITHOUT LIMITATION NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, SHALL BE THE GREATER OF $100 OR THE AMOUNT YOU PAID TO ACCESS THE SERVICES, TO THE EXTENT PERMITTED BY APPLICABLE LAW.

8. INDEMNIFICATION

You agree to indemnify, defend and hold PUZZLESPACE, ALONG WITH OUR REPRESENTATIVES, MANAGERS, THIRD-PARTY CONTRACTORS, EMPLOYEES, LICENSEES, LICENSORS, ADVERTISERS, AND AGENTS, harmless from and against any and all loss, costs, expenses (including reasonable attorneys’ fees and expenses), claims, damages and liabilities related to or associated with your use of our SERVICES and any alleged violation by you of these Terms. We reserve the right to assume the exclusive defense of any claim for which We are entitled to indemnification under this section. In such event, you shall provide us with such cooperation as we reasonably request.

9. GOVERNING LAW

Without regard to principles of conflicts of law, you agree that the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded, regardless of your place of residence. To the fullest extent permitted by law, you agree that these Terms will be construed in accordance with, and were entered into under, the laws of the country specified in the table below, based on which PUZZLESPACE entity provides the relevant Services. Except as otherwise provided for in Section X, you agree to submit to the personal and exclusive jurisdiction of the courts located within the specified forum

10. DISPUTE RESOLUTION

This Section 10 does not apply to residents of Japan, the European Union, or the European Economic Area.

PLEASE READ THIS SECTION CAREFULLY BECAUSE IT AFFECTS YOUR RIGHTS. BY AGREEING TO BINDING ARBITRATION, YOU WAIVE YOUR RIGHT TO LITIGATE DISPUTES THROUGH A COURT AND TO HAVE A JUDGE OR JURY DECIDE YOUR CASE. 

In order to expedite and control the cost of disputes, PuzzleSpace and you both agree that any legal or equitable claim, dispute, action or proceeding arising from or related to the Services (“Dispute”) will be resolved as follows to the fullest extent permitted by law:

Notice of Dispute: In the event of a Dispute, you or we must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the Dispute, and a proposed solution. You must send any Notice of Dispute by mail and email to us at the mailing and email addresses provided in the Contact Us section. We will send any Notice of Dispute to you by mail to your address if we have it, or otherwise to your email address.

Small Claims Court: You may choose to litigate any Dispute in small claims court (or the equivalent) in the Forum specified in Section IX, if the Dispute meets all the requirements to be heard in small claims court.

Binding Arbitration: If the Dispute is not resolved in small claims court, any other effort to resolve the Dispute will be conducted exclusively by binding arbitration as described in this section. You are giving up the right to litigate (or participate in as a party or class member) all Disputes in court before a judge or jury. Instead, all Disputes will be resolved before a neutral arbitrator, whose decision will be final except for a limited right of appeal under the Federal Arbitration Act or any other applicable law. Any court with jurisdiction over the parties may enforce the arbitrator’s award.

Exceptions to Arbitration: You and PuzzleSpace agree that the following Disputes are not subject to the above provisions concerning binding arbitration:

• Any Disputes seeking to enforce or protect, or concerning the validity of, any of your or PuzzleSpace’s intellectual property rights.

• Any claim for injunctive relief.

• Any claim you are authorized to bring to the attention of any federal, state, or local government agencies that can, if the law allows, permit those authorities to seek relief from us on your behalf.

Class Action Waiver: Any proceedings to resolve or litigate any Dispute in any forum will be conducted solely on an individual basis. Neither you nor we will seek to have any Dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity. No arbitration or proceeding will be combined with another without the prior written consent of all parties to all affected arbitrations or proceedings.

Arbitration Procedures: Any arbitration will be conducted by the Judicial Arbitration and Mediation Service (“JAMS”) under the applicable Consumer or Commercial Arbitration Rules in effect at the time the Dispute is filed. If JAMS is unavailable or unable to conduct an arbitration of the Dispute, an alternative arbitration service provider will be mutually agreed upon by both parties. You may request a telephonic or in-person hearing by following the JAMS rules. In a dispute involving $10,000 or less, any hearing will be telephonic unless the arbitrator finds good cause to hold an in-person hearing instead. The arbitrator may award the same damages to you individually as a court could. The arbitrator may award relief only to you individually, and only to the extent required to satisfy your individual claim.

Arbitrator’s Jurisdiction: The arbitrator shall have the power to rule on his or her own jurisdiction, including any objections with respect to the existence, scope, or validity of the arbitration agreement or to the arbitrability of any claim or counterclaim.

Arbitration Fees: Whoever files the arbitration pays the initial filing fee. If we file, we pay. If you file, you pay unless you get a fee waiver under the applicable arbitration rules. All other fees will be allocated as provided by the rules of the arbitration firm and applicable law. Each party will bear the expense of that party’s attorneys, experts, and witnesses, and other expenses, regardless of which party prevails, but a party may recover any or all expenses from another party if the arbitrator, applying applicable law, so determines.

Disputes Must Be Filed Within One Year: To the extent permitted by law, any Dispute under this agreement must be filed within one year in small claims court or in an arbitration proceeding. The one-year period begins when the Dispute or Notice of Dispute first could be filed. If a Dispute isn’t filed within one year, it’s permanently barred.

Temporary Injunctive Relief: Before the appointment of an arbitrator, either party may seek temporary injunctive relief in any court of competent jurisdiction without waiving its right to arbitration.

If this agreement to arbitrate is found to be illegal or unenforceable, the parties agree to the fullest extent permitted by applicable law that any Dispute relating to your use of the Services or these Terms shall be commenced and heard in accordance with Section 9.

当社は、以下の場合を除いて、個人情報を第三者に提供いたしません。

(1) お客様の同意がある場合

(2) 法令に基づく場合

(3) 人の生命、身体又は財産の保護のために必要がある場合であって、本人の同意を得ることが困難であるとき

(4) 公衆衛生の向上又は児童の健全な育成の推進のために特に必要がある場合であって、本人の同意を得ることが困難であるとき

(5) 国の機関若しくは地方公共団体又はその委託を受けた者が法令の定める事務を遂行することに対して協力する必要がある場合であって、本人の同意を得ることにより当該事務の遂行に支障を及ぼすおそれがあるとき

6.　開示等の求めに応じる手続き

個人情報の開示、訂正、利用停止、または第三者提供の停止を求める場合は、電子メールでお問い合わせください。

7.　本ポリシーの変更

当社では、本ポリシーの内容を予告なく変更させていただくことがあります。

ネクソンモバイルプライバシーポリシー

モバイルプライバシーポリシーこのネクソンモバイルプライバシーポリシー（以下「本ポリシー」といいます）は PuzzleSpace およびそれらの関係会社 が提供するモバイルアプリケーション（以下「本アプリ」といいます）を利用するユーザー（以下「利用者」といいます）から取得する情報（以下「利用者情報」といいます）の取扱いについて定めたものです。

利用者情報の保護を重要な責務であると考えております。 PuzzleSpace は、本ポリシーおよび関係法令を遵守のうえ、継続的に本アプリの運用の改善に努めてまいります。

1. 利用者情報の取得

利用者は、下に定める個人情報（「個人情報の保護に関する法律」に定める「個人情報」をいいます）および個人情報以外の利用者情報（以下「非個人情報」といいます）を取得することについて、同意するものとします。

(1) 利用者に関する情報

利用者が本アプリケーションを使用して会員登録をした場合などから、利用者からID、パスワードなどの利用者に関する情報を直接取得します。

(2) 端末情報

携帯電話、タブレット等の携帯端末を用いて本アプリを使用する場合、 PuzzleSpace は、当該携帯端末の情報として、端末固有ID（MACアドレス、端末識別ID、広告ID等）、IPアドレス、利用者が設定した携帯端末の名称、携帯端末の種類（型番等を含む）、周辺機器に関する情報、接続国に関する情報等を取得する場合があります。

2. 利用者情報の取得方法

利用者情報を下記の方法で取得いたします

(1) 直接取得

利用者が本アプリケーションを使用して会員登録をした場合、利用者情報を入力または本アプリケーションの機能またはサービスを利用した場合などの理由でPuzzleSpaceは、利用者から利用者情報を直接取得します。

3. 利用者情報の利用目的

(1) 本アプリおよび本アプリに関連したサービスを提供するため

(2) 本アプリおよび本アプリに関連したサービスを提供するにあたっての本人確認をするため

(3) 本アプリにおいて使用するアカウントを作成するため

(4) 本アプリをカスタマイズまたはパーソナライズするため

(5) 法令上の要請のため（本アプリの利用規約に所定の事項に関する権利行使や詐欺の防止、その他の違法行為の防止を想定しますが、これに限りません）

4. 第三者への情報の提供

PuzzleSpaceは、「3. 利用者情報の利用目的」に定める場合または以下に定める場合を除き、第三者に利用者の個人情報の提供を行わないものとします

(1) 法令上の要請に基づく提供

PuzzleSpaceは、法令上の要請に基づいて、第三者に利用者の個人情報を提供する場合があります。

(2) 健康や安全の確保を目的とした提供

PuzzleSpace は、利用者の個人情報を、利用者の健康や安全が脅かされており、緊急を要すると PuzzleSpace が判断した場合に、第三者または広く一般に開示する場合があります。

5. 情報セキュリティ対策

PuzzleSpaceは、利用者情報を保護するために組織的、人的、物理的および技術的に適切な安全管理措置を講ずるものとし、合理的な情報セキュリティ対策（例えば、ファイアーウォールやSSL暗号化を想定しますが、これに限りません）を維持いたします。但し、 PuzzleSpace は、採用する方法が最善の対策であることを保証せずまた、起こりうる情報セキュリティ上の脅威に対して、合理的な注意喚起を行いますが、その完全性を保証いたしません。そのため PuzzleSpaceは、不正アクセス、ハッキング、データ喪失その他の侵害行為が発生しないことを、 PuzzleSpaceに故意または重大な過失が認められる場合を除いて、保証いたしません。

PuzzleSpaceは、利用者情報に対して、利用者自らが最善の情報セキュリティを確保し、維持することを強くお勧めいたします（例えば、ログイン情報を共有しないようにしたり、本アプリ使用後にログアウトを行ったり等の方法がありますが、これに限りません）。

PuzzleSpaceは、日本国内または海外におけるその所在地において利用者情報を保管しておりますが、他の国に移転する場合があります。

PuzzleSpaceは、本ポリシーに基づき個人情報の提供が認められた第三者に対して、合理的なレベルの情報セキュリティ保護措置を要求するものとします。

6. 改定

PuzzleSpaceは、本ポリシーを随時改定することができるものとします。本ポリシーのいかなる改定も、変更後の本ポリシーが本アプリ掲載セッションに表示され、利用者が閲覧可能となった時点より効力を生じるものとします。本ポリシーの改定後も利用者が本アプリを保有または利用している場合、利用者は本ポリシーの改定に同意したものとみなされます。

7. 問い合わせ先

本ポリシーおよび本ポリシーに基づく利用者情報の取扱いに関するお問い合わせは、admin@puzzlespace.kr宛にご連絡ください。

PuzzleSpaceは、利用者に対して、利用者情報の変更を許諾しています。利用者は、本アプリを通して、利用者情報の全部または一部を変更することができます。利用者のプライバシーの保護と情報セキュリティの確保のため、 PuzzleSpaceは合理的な方法による本人確認を、変更の前に行います。 PuzzleSpaceは、当該変更が即時に反映されることを保証いたしません。

利　用　規　約

この規約は、お客様が、株式会社 PuzzleSpace （以下「当社」）が提供する「 PuzzleSpace 」サービス（以下「本サービス」）をご利用頂く際の取扱いにつき定めるものです。本規約に同意した上で本サービスをご利用ください。

第１条（定義）

　本規約上で使用する用語の定義は、次に掲げるとおりとします。

（1）本サービス : 当社が運営するサービス及び関連するサービス

（2）本コンテンツ : 本サービス上で提供される文字、音、静止画、動画、ソフトウェアプログラム、コード等の総称（投稿情報を含む）

（3）利用者 : 本サービスを利用する全ての方

（4）コイン : 本サービスのサービス及び有償コンテンツと交換可能な仮想通貨です

（5）登録利用者 : 本サイトの利用者登録が完了した方

（6）ＩＤ : 本サービスの利用のために登録利用者が固有に持つ文字列

（7）パスワード : ＩＤに対応して登録利用者が固有に設定する暗号

（8）登録情報 : 登録利用者が本サイトにて登録した情報の総称（投稿情報は除く）

（9）知的財産 : 発明、考案、植物の新品種、意匠、著作物その他の人間の創造的活動により生み出されるもの（発見または解明がされた自然の法則または現象であって、産業上の利用可能性があるものを含む）、商標、商号その他事業活動に用いられる商品または役務を表示するもの及び営業秘密その他の事業活動に有用な技術上または営業上の情報

（10）知的財産権 : 特許権、実用新案権、育成者権、意匠権、著作権、商標権その他の知的財産に関して法令により定められた権利または法律上保護される利益に係る権利

第２条（本規約への同意）

１　利用者は、本利用規約に同意頂いた上で、本サービスを利用できるものとします。

２　利用者が、本サービスをスマートフォンその他の情報端末にダウンロードし、本規約への同意手続を行った時点で、利用者と当社との間で、本規約の諸規定に従った利用契約が成立するものとします。

３　利用者が未成年者である場合には、親権者その他の法定代理人の同意を得たうえで、本サービスをご利用ください。

４　未成年者の利用者が、法定代理人の同意がないにもかかわらず同意があると偽りまたは年齢について成年と偽って本サービスを利用した場合、その他行為能力者であることを信じさせるために詐術を用いた場合、本サービスに関する一切の法律行為を取り消すことは出来ません。

５ 本規約の同意時に未成年であった利用者が成年に達した後に本サービスを利用した場合、当該利用者は本サービスに関する一切の法律行為を追認したものとみなされます。

第３条（規約の変更）

１　当社は、利用者の承諾を得ることなく、いつでも、本規約の内容を改定することができるものとし、利用者はこれを異議なく承諾するものとします。

２　当社は、本規約を改定するときは、その内容について当社所定の方法により利用者に通知します。

３　前本規約の改定の効力は、当社が前項により通知を行った時点から生じるものとします。

４　利用者は、本規約変更後、本サービスを利用した時点で、変更後の本利用規約に異議なく同意したものとみなされます。

第４条（アカウントの管理）

１　利用者は、利用に際して登録した情報（以下、「登録情報」といいます。メールアドレスやID・パスワード等を含みます）について、自己の責任の下、任意に登録、管理するものとします。利用者は、これを第三者に利用させ、または貸与、譲渡、名義変更、売買などをしてはならないものとします。

２　当社は、登録情報によって本サービスの利用があった場合、利用登録をおこなった本人が利用したものと扱うことができ、当該利用によって生じた結果ならびにそれに伴う一切の責任については、利用登録を行った本人に帰属するものとします。 

３　利用者は、登録情報の不正使用によって当社または第三者に損害が生じた場合、当社および第三者に対して、当該損害を賠償するものとします。 

４　登録情報の管理は、利用者が自己の責任の下で行うものとし、登録情報が不正確または虚偽であったために利用者が被った一切の不利益および損害に関して、当社は責任を負わないものとします。 

５　登録情報が盗用されまたは第三者に利用されていることが判明した場合、利用者は直ちにその旨を当社に通知するとともに、当社からの指示に従うものとします。

第５条（個人情報等の取り扱い） 

個人情報及び利用者情報については、当社が別途定める「 PuzzleSpace サービスプライバシーポリシー」に則り、適正に取り扱うこととします。

第６条（禁止行為）　

本サービスの利用に際し、当社は、利用者（以下「利用者」）に対し、次に掲げる行為を禁止します。当社において、利用者が禁止事項に違反したと認めた場合、利用停止、投稿削除等、当社において必要と判断した措置を取ることができるものとし、利用者はこれを異議なく同意するものとします。

（１）当社または第三者の知的財産権を侵害する行為

（２）当社または第三者の名誉・信用を毀損または不当に差別もしくは誹謗中傷する行為

（３）当社または第三者の財産を侵害する行為、または侵害する恐れのある行為 

（４）当社または第三者に経済的損害を与える行為

（５）当社または第三者に対する脅迫的な行為

（６）コンピューターウィルス、有害なプログラムを仕様またはそれを誘発する行為 

（７）本サービス用インフラ設備に対して過度な負担となるストレスをかける行為 

（８）当サイトのサーバーやシステム、セキュリティへの攻撃 

（９）当社提供のインターフェース以外の方法で当社サービスにアクセスを試みる行為

（１０）一人の利用者が、複数の利用者IDを取得する行為

（１１）上記の他、当社が不適切と判断する行為

第７条 （コンテンツの取り扱い）

１　利用者は､本サービスのコンテンツを当社の定める範囲内でのみ使用することができるものとします｡ 

２　本サービスで提供される全てのコンテンツに関する権利は当社が有しており､利用者に対し､当社が有する特許権､実用新案権､ 意匠権､商標権､著作権､その他知的財産権の実施または使用許諾をするものではありません｡ 

３　利用者は､当社の定める使用範囲を超えていかなる方法によっても複製､送信､譲渡（利用者同士の売買も含みます）､貸与､翻訳､翻案、無断で転載、二次使用、営利目的の使用、改変、逆アセンブル、逆コンパイル、リバースエンジニアリング等を行う事を禁止します。 

４　前項に関わらず､退会等により利用者が利用者資格を喪失した場合は､提供されたコンテンツの使用権も消滅するものとします｡ 

第８条（有料コンテンツ）

１　本サービス内の一部については、対価を支払うことにより有料コンテンツを購入することができます。有料コンテンツの金額、決済方法その他の事項は、別途当社が定め、本サービスまたは当社ウェブサイトに表示します。

２　当社は、本サービスにおいて無償または有料とされているコンテンツについて、当社の裁量でその価格を変更することがあります。

３　利用者が有料コンテンツの対価の支払いを遅滞した場合、利用者は、年14.6％の割合による遅延損害金を当社に対して支払うものとします。

４　有料コンテンツは、利用者本人の登録情報に対してのみ使用が許諾されます。

第９条（コインの取り扱い）

１　当社は、本サービスにおいて利用者がコインを購入した場合、当社がキャンペーンを実施する場合その他の場合に、当社の定める方法により、利用者にコインを付与します。コインの購入単位、価格、有効期間、その他のコインの付与条件は、当社が定め、本サービス上に表示します。

２　PuzzleSpace コインの有効期間は、コインが付与された日から6か月とします。

３　当社は、利用者が取得したコインについて、法令上必要な場合を除き、一切払い戻しを行いません。法令に基づきコインを払い戻す場合の払戻方法および条件は、別途当社が定める方法で掲示するものとします。

第１０条（換金行為の禁止等）

本サービス内で取得した一切のコンテンツまたは仮想通貨については、直接、第三者による仲介又はインターネットオークション等その手段を問わず、売買その他、金銭その他現実世界における対価を授受する形でのあらゆる譲渡、譲受、貸与、借用等する行為（いわゆるRMT【リアルマネートレード】を含みますが、これに限られません。また、本サービス内におけるユーザーの行為に対して金銭その他、現実世界における対価を授受することも含みます。）を禁止いたします。

第１１条（免責）

１　当社は、本サービスの内容変更、中断、終了によって生じたいかなる損害についても、一切責任を負いません。

２　当社は、利用者の本サービスの利用環境について一切関与せず、また一切の責任を負いません。

３　当社は、本サービスが利用者の特定の目的に適合すること、期待する機能・商品的価値・正確性・有用性を有すること、利用者による本サービスの利用が利用者に適用のある法令または業界団体の内部規則等に適合すること、および不具合が生じないことについて、何ら保証するものではありません。

４　当社は、本サービスが全ての情報端末に対応していることを保証するものではなく、本サービスの利用に供する情報端末のＯＳのバージョンアップ等に伴い、本サービスの動作に不具合が生じる可能性があることにつき、利用者はあらかじめ了承するものとします。当社は、かかる不具合が生じた場合に当社が行うプログラムの修正等により、当該不具合が解消されることを保証するものではありません。

５　利用者は、AppStore、GooglePlay等のサービスストアの利用規約および運用方針の変更等に伴い、本サービスの一部又は全部の利用が制限される可能性があることをあらかじめ了承するものとします。

６　当社は、本サービスを利用したことにより直接的または間接的に利用者に発生した損害について、一切賠償責任を負いません。

７　当社は、利用者その他の第三者に発生した機会逸失、業務の中断その他いかなる損害（間接損害や逸失利益を含みます）に対して、当社が係る損害の可能性を事前に通知されていたとしても、一切の責任を負いません。

８　第１項乃至前項の規定は、当社に故意または重過失が存する場合又は契約書が消費者契約法上の消費者に該当する場合には適用しません。

９　前項が適用される場合であっても、当社は、過失（重過失を除きます。）による行為によって利用者に生じた損害のうち、特別な事情から生じた損害については、一切賠償する責任を負わないものとします。　

１０　本サービスの利用に関し当社が損害賠償責任を負う場合、当該損害が発生した月に利用者から受領した利用額を限度として賠償責任を負うものとします。

１１　利用者と他の利用者との間の紛争及びトラブルについて、当社は一切責任を負わないものとします。利用者と他の利用者でトラブルになった場合でも、両者同士の責任で解決するものとし、当社には一切の請求をしないものとします。

１２　利用者は、本サービスの利用に関連し、他の利用者に損害を与えた場合または第三者との間に紛争を生じた場合、自己の費用と責任において、かかる損害を賠償またはかかる紛争を解決するものとし、当社には一切の迷惑や損害を与えないものとします。

１３　利用者の行為により、第三者から当社が損害賠償等の請求をされた場合には、利用者の費用（弁護士費用）と責任で、これを解決するものとします。当社が、当該第三者に対して、損害賠償金を支払った場合には、利用者は、当社に対して当該損害賠償金を含む一切の費用（弁護士費用及び逸失利益を含む）を支払うものとします。

１４　利用者が本サービスの利用に関連して当社に損害を与えた場合、利用者の費用と責任において当社に対して損害を賠償（訴訟費用及び弁護士費用を含む）するものとします。

第１２条（広告の掲載について） 

利用者は、本サービス上にあらゆる広告が含まれる場合があること、当社またはその提携先があらゆる広告を掲載する場合があることを理解しこれを承諾したものとみなします。本サービス上の広告の形態や範囲は、当社によって随時変更されます。 

第１３条（サービスの終了）

１　当社は、利用者への適宜の方法で通知することにより、本サービスを終了することができるものとします。

２　利用者は、本サービスが終了した場合、有料コンテンツを利用する権利一切を失い、以後、当該有料コンテンツを利用できなくなることをあらかじめ異議なく同意するものとします。

３　当社は、本サービスが原因を問わず終了した場合、これに起因して生じた利用者または第三者が被った損害について、一切責任を負わないものとします。

第１４条（権利譲渡の禁止）

１　利用者は、予め当社の書面による承諾がない限り、本規約上の地位および本規約に基づく権利または義務の全部または一部を第三者に譲渡してはならないものとします。

２　当社は、本サービスの全部または一部を当社の裁量により第三者に譲渡することができ、その場合、譲渡された権利の範囲内で利用者のアカウントを含む、本サービスに係る利用者の一切の権利が譲渡先に移転するものとします。

第１５条（分離可能性）

本規約のいずれかの条項又はその一部が、消費者契約法その他の法令等により無効又は執行不能と判断された場合であっても、本規約の残りの規定及び一部が無効又は執行不能と判断された規定の残りの部分は、継続して完全に効力を有するものとします。

第１６条（当社への連絡方法）

本サービスに関する利用者の当社へのご連絡・お問い合わせは、本サービスまたは当社が運営するwebサイト内の適宜の場所に設置するお問い合わせフォームからの送信または当社が別途指定する方法により行うものとします。

第１７条（準拠法、管轄裁判所）

１　本規約の有効性，解釈及び履行については，日本法に準拠し，日本法に従って解釈されるものとする。

２　当社と利用者等との間での論議・訴訟その他一切の紛争については、訴額に応じて、東京簡易裁判所又は東京地方裁判所を専属的合意管轄裁判所とします｡
